Unfair Commercial Practices Directive, link

The author provides an overview of the impacts of the Law N°2008-3 of January 3, 2008 which has the purpose of enacting rules in order to protect consumer interests in various sectors (electronic communications services or banking services). The author notes in particular a reduction of the criminal sanctions for breaches of the rules relating to commercial practices, the decriminalization of the refusal to communicate the general terms and conditions, a new and stricter definition of resale at a loss, new provisions on the criminal liability of legal entities, the criminalization of unfair commercial practices and aggressive commercial practices and the substitution of deceptive advertising by misleading commercial practices.
