Unfair Commercial Practices Directive, link

The author presents Directive 2005/29/EC concerning unfair business-to-consumer commercial practices with the aim of improving the quality of the fragmentary legislation in the field of unfair competition through a general duty of fair trading, clarify consumers' rights and boost cross border trading. The author notes that unfortunately the scope of the directive is limited to unfair business-to-consumer commercial practices and doesn't include business-to-business practices. The article presents the mechanism of operation of the directive - general clause and a list of per se unfair practices and concludes with some thoughts on implementation of the directive into the Slovenian law.
