    Unfair commercial practices in consumer contracts are quite common in the practices of entrepreneurs. Questions related to unfair commercial practices on the ground of EU legislation are regulated in EC Directive of 2005/29/ES dated 11. 5. 2005 (the "Directive"). Legal regulation of unfair practices was implemented into the law of the Czech Republic by Section 4 of Act No. 634/1992 Coll., on Consumer Protection. As the correct implementation of legal regulation prohibiting unfair commercial practices was not reached, the legislator has eliminated the drawbacks by amending the Act on Consumer Protection by the Act No. 378/2015 Coll. through literal borrowing of the wording of the stipulations of the Directive. This article concerns the interpretation and applicability of the Grand General Clause of unfair commercial practices in the light of the case law of the ECJ.
