This article discusses the decision of the Belgian Court of Cassation of 2 November 2012 in which the Court, after having referred the case to the European Court of Justice, decides that the Belgian rules on restricted sales periods fall under the scope of the Directive 2005/29, hence are unlawful as the per se prohibition of these commercial practices are prohibited. According to the author, the decision of the Belgian Supreme Court makes an end to the Belgian regulations on the restricted sales periods.
