  • Headnote
    The law implementing the UCP Directive (Law 29/2009 of 30 December amending the existing Unfair Competition and Advertising regulations in order to improve the rights of consumers and users) has added to the Unfair Competition Law (Law 3/1991 of 10 January) a new chapter on Codes of Conduct so that consumers and users are able to gain access to an extra-judicial system for the solution of disputes.

    These regulations are inclusive of legal actions against the entrepreneurs that decided to join the relevant Code of Conduct when there is an unfair competition infringement. Additionally, the chapter relating to procedural rules has also been modified so that the onus of proof for the statements made by the entrepreneurs is updated in accordance with the UCP Directive so as to add new legal actions to protect the consumers against unfair practices.
