The author focuses on the first Annex of the UCP Directive (containing the so-called "black list") consisting of 31 per se prohibitions applicable in all EU countries regardless of any circumstances.

The author indicates that these provisions are not implemented in an identical manner in all Member States and she invokes case law of the Court of Justice tackling certain issues relating to the construction of the UCP Directive.

The conclusion of the author is that the purposes that justified the introduction of the black list, have not been achieved.
