This article provides a general overview of the rules on unfair commercial practices contemplated by the UCP Directive and the Italian Legislative Decrees no. 145 and no. 146 (which implement the UCP Directive in the Italian legislation system). In the first part of the article the author distinguishes between unfair practices vis-à-vis consumers and unfair practices vis-à-vis competitors. The second part discusses the administrative remedies (with specific focus on the procedural powers of the Italian Competition Authority) and the judicial remedies (with specific focus on individual and collective actions). In the third part of the article, reference is also made to cross-border infringements and their enforcement.
