Unfair Commercial Practices Directive, Chapter 1, Article 2, (k)

This article discusses the Commission's 2009 guidance note. It outlines the definition of a transactional decision in article 2(k) of the Directive, and explores several types of commercial practices including: (1) a pre-purchase decision, such as a decision to enter a shop that has been advertised; and (2) a post-purchase decision, such as the right to exchange a product. It notes that an unfair commercial practice needs only be capable of influencing a consumer.
