Unfair Commercial Practices Directive, Chapter 2, Article 5

This fairly general article focuses on the relationship between the new provisions on unfair contractual practices (as introduced by the UCP Directive) and the previous Greek regime of unfair competition under the law no 146/1914.

It emphasises that the UCP Directive introduces new criteria for what constitutes an unfair commercial practice: the contradiction to the requirements of professional diligence and the material distortion of the economic behavior of the consumer that does not include the moral distortion of the behavior of the consumer, which is a prerequisite in the Greek unfair competition law.
