    This article deals with the element of unfairness, as it is described in the local unfair competition law (no 146/1914) and in the UCP Directive.

    As regards the UCP Directive, the author focuses on the general clause of article 5.1. The author also criticizes that, according to the UCP Directive, a commercial practice is deemed unfair when it is contrary to the requirements of professional diligence and it materially distorts the economic behavior of the consumer, leaving aside the distortion of the moral behavior of the consumer (that it is one of the bases of unfair competition according to the Greek unfair competition law).

    In addition, the article discusses the categories of unfair commercial practices that are introduced by the UCP Directive.

    Finally, it also provides guidance on how the new provisions of the UCP Directive will supplement the existing provisions of Greek unfair competition law.
