    In the European Union, the free movement of goods and legal harmonisation complement each other without the Agreements providing any basis for determining where one ends and the other begins. The broad judicial discretionary power over the free movement of goods predetermines the content and extent of judicial harmonisation. Member states have limited ability to address consumer protection. Negative integration is more impactful than positive integration, as the EU’s legal principles create a more advantageous position for market actors over Member States. Economic interests predominate over non-economic ones as a consequence, especially with the CJEU refusing to consider the social significance of Member State measures.
