The author of this article deals with the question of how the elements of the Trade Mark Directive are to be incorporated into the body of rules on comparative advertising. In doing so, he discusses the decision of the European Court of Justice ECJ C-487/07, L'Oréal/Bellure and critically reviews the requirements of the Directive concerning misleading and comparative advertising (2006/114/EC).
