Headnote

The obligation to indicate the total price for goods and services only applies to the communication of all those price elements which a trader will impose in each event regardless of the choice of the consumer, and not to price elements which depend on the consumer's decision.
Facts

Plaintiff claimed that defendant was guilty of not indicating the final price with regards to one of its advertisements. This was allegedly the case because plaintiff did not factor the price of the underlying cable subscription into its digital television service.

Both in first instance, as on appeal did the courts agree that the defendant was under no obligation to include the underlying cable subscription into the final price.

Plaintiff then appealed to the Supreme Court.
Legal issue

The court relies on parliamentary preparation to reach its findings and also on factual circumstances when it refutes plaintiff's claim that it is contradictory to state that is necessary to have a cable subscription to be able to enjoy digital television whilst also stating that a cable subscription is not a mandatory extra service that requires payment as the consumer who already has a cable subscription is not required to renew that subscription in order to be able to enjoy digital television.

Arrest

I. RECHTSPLEGING VOOR HET HOF
Het cassatieberoep is gericht tegen het arrest van het hof van beroep te
Antwerpen van 14 juni 2012.
Advocaat-generaal André Van Ingelgem heeft geconcludeerd.

II. CASSATIEMIDDEL

De eiseres voert in haar verzoekschrift dat aan dit arrest is gehecht, een middel
aan.

III. BESLISSING VAN HET HOF

Beoordeling

Eerste onderdeel

1. Artikel 8 van de wet van 6 april 2010 betreffende marktpraktijken en consumentenbescherming, hierna Wet Marktpraktijken, bepaalt dat elke reclame voor consumenten die gewag maakt van een prijs, die moet vermelden overeenkomstig de voorschriften van met name de artikelen 6 en 7. Krachtens artikel 6 Wet Marktpraktijken moet de aangeduide prijs de door de consument totaal te betalen prijs zijn, waaronder is begrepen: de belasting over de toegevoegde waarde, alle overige taksen en de kosten van alle diensten die door de consument verplicht moeten worden bijbetaald.

2. Uit de wetgeschiedenis blijkt dat de verplichting om voor de goederen en diensten de totale prijs aan te duiden enkel geldt voor de weergave van alle prijsbestanddelen die de onderneming in alle gevallen tot een geheel vermag te becijferen en niet wanneer dit niet mogelijk is omdat de totale prijs afhankelijk is van beslissingen van de consument.

3. Het arrest stelt vast dat de consument die reeds beschikt over een kabelabonnement niet verplicht is een nieuw of bijkomend kabelabonnement te nemen om na de installatie van de decoder digitale televisie te kunnen kijken. Het vermocht derhalve, zonder schending van de in het onderdeel vermelde wetsbepalingen, te oordelen dat het nemen van een kabelabonnement geen verplicht bij te betalen dienst is in de zin van artikel 6 Wet Marktpraktijken.
Het onderdeel kan niet worden aangenomen.

Tweede onderdeel

4. Het is niet tegenstrijdig te oordelen, eensdeels, dat het noodzakelijk is om over een kabelabonnement te beschikken om digitale televisie te kunnen kijken en, anderdeels, dat het nemen van een kabelabonnement geen verplicht bij te betalen dienst is in de zin van artikel 6 Wet Marktpraktijken omdat de consument die reeds beschikt over een kabelabonnement niet verplicht is een nieuw of bijkomend kabelabonnement te nemen om na de installatie van de decoder digitale televisie te kunnen kijken.

Het onderdeel mist feitelijke grondslag.

Dictum

Het Hof,

Verwerpt het cassatieberoep.
