    The plaintiff, a consumer, sued an organiser of a game of chance for having published the terms and conditions of the game on the envelope, which the consumer had not read. The plaintiff claimed damages of more than 10.000 EUR.

    The Supreme Court stated that, based on the facts found by the lower courts, the general terms and conditions of the game were adequately published.

    According to the Supreme Court, in reviewing whether there was a misleading advertisement, the key element was whether the advertising had a decision-influencing impact on the average consumer to enter into a transaction. Accordingly, the Supreme Court argued that in this case, for an average consumer, the advertising was not misleading, did not create a false impression, and had no influence on his transactional decision.
