    The judgement refers to the scope of obligation on indicating prices of goods and services. At a petrol station, the prices for fuel were not indicated in the same way, which could be misleading for consumers.

  • Fakty

    By decision issued by the Podkarpackie Voivodship Inspector of Trade Inspection,  the company that operated the petrol station was imposed a fine of PLN 5,000, pursuant to art. 6 clause 1 of the Act of May 9, 2014 on informing about prices of goods and services. The fine was imposed for not showing information on: 1) the prices of five types of fuel on offer in such a way that they are legible for drivers of vehicles approaching the station by one public road and 2) the price of two types of fuel offered by the station in such a way that they are legible for drivers of vehicles approaching the station by another public road.

    The assessment whether, in a given case, displaying the unit price of a good (service) would be or would not be useful due to the type or purpose of the good and whether it can be omitted, is a statutory guideline for the competent minister to regulate this issue by regulation. It does not mean that the usefulness of price display can be decided by the entrepreneur each time, adopting their own criteria for the purpose of informing about the prices of relevant products. The entrepreneur is obliged to comply with the provisions of the Regulation of the Minister of Development of 9 December 2015 on the display of prices of goods and services, which in the case of displaying prices at petrol stations, does not exempt from this obligation any category of fuel (e.g. in the context of their quality or fulfillment the appropriate ceiling in the sales volume).

    The Supreme Administrative Court dismissed the plaintiff’s appeal und upheld the decision of the President of Competition and Consumer Protection Office. An operator of a petrol station has to display prices of all fuel types in the same way and may not choose which are hidden from view or display them in a way that could be troublesome to read.
