    Comparative advertising that does not satisfy the cumulative conditions set out in article 4 of Directive 2006/114/EC of the European Parliament and of the Council of December 12, 2006, on misleading and comparative advertising, is unlawful.

    The defendant is condemned to refrain from supplying, in its network of franchised stores, any advertising or promotional material that uses the comparison of brand perfumes "EKYVAL" with the plaintiffs' brands (L'oreal, Lancôme, Polo Lauren, Yves Saint Laurent, Jean Cacharel, Dieses, Laroche, Loris Azzaro, Clarins and Thierry Mugler), for infringement of article 4 of Directive 2006/114 / EC, for advertising those perfumes as imitations of the other brands.
