    Consumer status for the purposes of this legislation. The economic aim does not necessarily exclude the consumer from the status of a natural person. Nullity. Indetermination on the object of the contract and the price: abstract wording of the contract has precisely the purpose of avoiding the application of the legislation on rights of use per shift of real estate for tourist use and tax rules.

  • Hechos

    Lawsuit in which the plaintiff urges the nullity of the contracts signed in 2009, 2010 and 2011, through which it acquired (it is estimated that for purely investing purposes given the documents for resale or lease) the rights of use and enjoyment of certain weeks in certain holiday resorts, requesting the defendant's sentence to pay the amounts paid as payments and installments, and the return of the double payment in advance, as well as legal interests from the filing of the claim.

    The claim was dismissed in First Instance, so it is appealed before the Provincial Court of Santa Cruz de Tenerife.

  • Cuestión jurídica

    The possibility that the plaintiffs' profit motive excludes the consumer from their status of natural person and, therefore, the protection that the General Law of Consumers and Users does not apply to them, which would entail the full effectiveness of the contracts signed between the parties.

  • Decisión

    The Provincial Court recognizes the status of consumers of the plaintiffs, independent of the economic aim, so that the contracts entered into are null and void.
