  • Hechos

    The plaintiffs signed contracts with Silverpoint Vacations, for which they were entitled to the use of apartments for holiday periods in a resort, along with a declaration of conformity and a resale contract.

    The plaintiffs requested the declaration of nullity of the contract, which was estimated at First Instance. The defendant appealed to the Provincial Court, which upheld the appeal and revoked the judgment of the First Instance.

    The plaintiffs filed an appeal against the judgment of the Provincial Court.

  • Decisión

    The Provincial Court considers in its judgment:

    a) That the plaintiffs contracted the occupations of the apartments to incorporate them into a commercialization process, which excludes their condition of consumers;

    b) There is not appreciation of absence of any of the essential elements of the contract;

    c) There is no intent in the conduct of the defendant that could have induced the plaintiffs to hire.

    The Supreme Court upheld the appeal made by the plaintiffs, condemning the defendant. The Court recognizes the status of consumers of the plaintiffs, independent of the economic aim so that the contracts entered into are null and void.
