Turn-taking of real estate for tourist use through a formula that sought to avoid the application of the law that regulates the matter.

  • Hechos

The parties signed an adhesion contract by which the plaintiff acquired vacation rights consisting of accommodation in a holiday club. The appellant did not simply acquire the provision of services through a vacation package, but the integration into a community by paying a regular entry fee and quotas, which shows that she was hiring a turn-taking of real estate for tourist use through a formula that tried to avoid the application of the law that regulates the matter.

  • Cuestión jurídica

The applicant did not simply acquire services (what is known as a vacation package), but integration into a community (membership), through the payment of an entry fee and periodic maintenance fees. It seems clear that she was hiring turn-taking of real estate for tourist use, although through a formula that sought to avoid the application of specific regulations on the subject.

  • Decisión

Nullity of the contract. This profit-making intention does not necessarily exclude the consumer of a natural person status. It is exclusive when it is a legal entity.
