Excerpt from the criminal register

An excerpt from the criminal register contains unexpunged convictions by courts in the Slovak Republic, courts of other EU Member States, or courts of other States whose decisions have been recognised by a court in the Slovak Republic, including information on the status of enforcement of the sentences, protective measures and appropriate restrictions and obligations imposed, provided that, pursuant to a court decision or by law, the offender is not to be treated as if they had not been convicted.

Copy from the criminal register

A copy from the criminal register is a public document indicating

  • any final conviction, including convictions by courts of other EU Member States or courts of other States whose decisions have been recognised by a court in the Slovak Republic;
  • the status of enforcement of the sentence and the status of enforcement of the protective measure;
  • convictions, even if expunged by means of a court decision or by law.

A copy from the criminal register also contains information on

  • a final decision conditionally suspending criminal proceedings, issued by a court or by a Public Prosecutor;
  • a final decision on the approval of the conciliation and suspension of criminal proceedings, issued by a court or by a Public Prosecutor;
  • a final conviction of a citizen of the Slovak Republic or a final conviction of a person residing permanently in the Slovak Republic, that has been imposed by a court other than a court of an EU Member State and has not been recognised by a court in the Slovak Republic, with the remark that this decision has no legal effect in the Slovak Republic and is indicated only for information.

In a copy from the criminal register issued pursuant to Section 14(2) and (3) of the Act on criminal records and amending some other acts, any unexpunged convictions imposed by a court of another EU Member State or a court of another State that have not been recognised by a court in the Slovak Republic are to bear a remark that these decisions have no legal effect in the Slovak Republic and are indicated only for information.

Reply to a request for information from the criminal register

If the central authority of another EU Member State asks the General Prosecutor’s Office for information from the criminal register concerning a citizen of the Slovak Republic, the General Prosecutor’s Office is to provide it within ten working days with information concerning:

  • a final unexpunged conviction imposed by a court in the Slovak Republic which is recorded in the criminal register;
  • a final unexpunged conviction imposed by a court of another EU Member State that has been updated pursuant to Section 17(4) of the Act on criminal records and amending some other acts;
  • a final unexpunged conviction by a court in other States which has been provided and is recorded in the criminal register.
