Malta intends to derogate from Article 9(2) as this is not in line with the procedural law in Malta.
The costs referred to in Article 11(2) of this Regulation are of a fixed fee of €50 for every document that has to be served.
This fee must be paid prior service. The documents will be returned without processing if the notification request is not accompanied by a bank receipt after the aforementioned payment is made. The payment of the fee is to be made by bank transfer payable to the person to whom the money are to be returned without processing. It is not possible because proof of service is required. However if judgment is given against a person and such person has not been duly notified in advance by summons, such person may within three months from the judgment, request that the case be heard again.
