In some cases, when the applicant or the intervening party in the proceedings is not Belgian and the respondent is Belgian, the latter may, in the absence of an international agreement providing for dispensation and except in special circumstances, request that the applicant or the intervening party provide surety to guarantee payment of damages arising from the action. This is provided for in Article 851 of the Judicial Code.
The costs of bailiffs and lawyers (see above) and translators and interpreters (see below) must also be taken into account, as appropriate.
Stage in civil proceedings when a party must settle fixed costs
Some costs must be settled before an action is brought. This applies to the registry fee, which is collected when the case is entered in the register.
Costs arising during the proceedings are generally collected while the proceedings are underway.
For some costs a reserve has to be established. In this way, experts are paid from a reserve established by the party that sought the measure of inquiry. Likewise, Article 953 states that the party requesting that a witness be heard must, before such hearing, deposit a reserve with the registrar representing the amount of the allowance and the reimbursement of costs (travel, etc.).
Costs in legal proceedings are sometimes advanced by lawyers and therefore included in their statement of costs and fees.
Fixed costs due from all parties in criminal proceedings
The issue of fixed costs in criminal proceedings is regulated under Article 91 et seq. of the Royal Decree of 28 December 1950.
Variable costs in criminal proceedings
If the victim files a complaint with an application to join proceedings as a civil party with the investigating judge (Article 66 of the Code of Criminal Procedure), the latter has the option to request that the victim deposit a certain amount of money with the registrar of the court. If clients do not have adequate resources to meet the costs of legal proceedings, they may apply, directly or through their lawyer, to the legal assistance office. They may, depending on their degree of insolvency, be exempted, in full or in part, from paying the costs of bailiffs, experts, etc. This matter is governed by Article 664 et seq. of the Judicial Code.

This contribution is termed the ‘case preparation allowance’ and is a one-off contribution calculated according to a scale based on the amounts involved in the case. It does not necessarily cover all of the fee costs. A Royal Decree of 26 October 2007 determines the amounts of this ‘case preparation allowance’. The amounts are minima and maxima and it is for the judge to assess the amount of the allowance within this range.
In some instances the court may not award legal costs against the losing party but settle this question differently (shared costs, etc.).

In deze casestudy over familierecht – echtscheiding, werd de lidstaten gevraagd om de partij die de echtscheiding aanvraagt, advies te geven over de proceskosten, teneinde de volgende situaties te onderzoeken:
Zaak A – Nationale situatie: een koppel huwt. Later gaan de echtgenoten uit elkaar en komen zij overeen om uit de echt te scheiden.
Zaak B – Grensoverschrijdende situatie: twee onderdanen van dezelfde lidstaat (lidstaat A) huwen. Het huwelijk vindt plaats in lidstaat A. Na het huwelijk verhuist het koppel naar een andere lidstaat (lidstaat B), waar het zijn verblijfplaats vestigt om er te wonen en te werken. Kort daarna gaat het koppel uit elkaar: de vrouw keert terug naar lidstaat A en haar echtgenoot blijft in lidstaat B. Het koppel is het eens om uit de echt te scheiden. Na haar terugkeer naar lidstaat A vraagt de vrouw onmiddellijk de echtscheiding aan voor de rechterlijke instanties van lidstaat B.
Belangrijke opmerking vooraf: in België bestaat er geen regeling voor de kosten en erelonen van advocaten (deze kosten en erelonen hangen af van de moeilijkheidsgraad en het belang van de zaak, de naam en de reputatie van de advocaat, de spoedeisendheid van de zaak, de uitkomst van de zaak,…). In België moeten de advocaten echter beroepsregels in acht nemen en zijn zij wettelijk verplicht hun erelonen met een billijke gematigdheid vast te stellen (zie supra).

In deze casestudy over familierecht – gezagsrecht over de kinderen, werd de lidstaten gevraagd om de eiser advies te geven over de proceskosten, teneinde de volgende situaties te onderzoeken:
Zaak A – Nationale situatie: twee personen hebben een aantal jaren ongehuwd samengeleefd. Zij hebben een kind van drie jaar wanneer zij uit elkaar gaan. Bij rechterlijke beslissing krijgt de moeder het gezagsrecht over het kind en de vader een omgangsrecht. De moeder stelt een rechtsvordering in tot inperking van het omgangsrecht van de vader.
Zaak B – Grensoverschrijdende situatie waarin u advocaat bent in lidstaat A: twee personen hebben een aantal jaren ongehuwd samengeleefd in een lidstaat (lidstaat B). Zij hebben samen een kind maar gaan onmiddellijk na de geboorte van het kind uit elkaar. Bij rechterlijke beslissing in lidstaat B krijgt de moeder het gezagsrecht over het kind en de vader een omgangsrecht. De moeder en het kind gaan, met toestemming van de rechter, in een andere lidstaat wonen (lidstaat A) en de vader blijft in lidstaat B. Een paar jaar later stelt de moeder in lidstaat A een rechtsvordering in tot wijziging van het omgangsrecht van de vader.
Belangrijke opmerking vooraf: in België bestaat er geen regeling voor de kosten en erelonen van advocaten (deze kosten en erelonen hangen af van de moeilijkheidsgraad en het belang van de zaak, de naam en de reputatie van de advocaat, de spoedeisendheid van de zaak, de uitkomst van de zaak,…). In België moeten de advocaten echter beroepsregels in acht nemen en zijn zij wettelijk verplicht hun erelonen met een billijke gematigdheid vast te stellen (zie supra).

Met de instemming van de vader verhuizen moeder en kind naar een andere lidstaat (lidstaat A) waar zij hun verblijfplaats vestigen.
Er blijft een geschilpunt bestaan. Dat heeft betrekking op het bedrag van de alimentatie dat de vader aan de moeder is verschuldigd voor het levensonderhoud en de opvoeding van het kind. De moeder stelt daartoe in lidstaat A een rechtsvordering in.

Zaak B – Grensoverschrijdende situatie: een bedrijf waarvan het hoofdkantoor in lidstaat B is gevestigd, levert aan een koper in lidstaat A goederen met een waarde van 20 000 euro. Op de overeenkomst is het recht van lidstaat B van toepassing en de overeenkomst is opgesteld in de taal van lidstaat B. De verkoper werd niet betaald omdat de koper in lidstaat A vindt dat de goederen niet in overeenstemming zijn met hetgeen was overeengekomen. De verkoper stelt in lidstaat A een rechtsvordering in tot volledige betaling van de prijs, zoals is bepaald in de overeenkomst met de koper.

Elke betrokkene (fabrikant, installateur en eindklant) is verzekerd. De oorzaak van de brand wordt betwist. Niemand wil de klant schadeloosstellen.
De klant stelt een rechtsvordering in tot volledige schadeloosstelling door de fabrikant, de installateur en de verzekeringsmaatschappijen.
Zaak B – Grensoverschrijdende situatie: een fabrikant van verwarmingstoestellen in lidstaat B levert een verwarmingstoestel aan een installateur in lidstaat C. De installateur verkoopt het verwarmingstoestel door aan een klant in lidstaat A en installeert dat in diens huis. Kort daarna ontstaat er brand in het huis.
