The costs of bailiffs and lawyers (see above) and translators and interpreters (see below) must also be taken into account, as appropriate.
Stage in civil proceedings when a party must settle fixed costs
Some costs must be settled before an action is brought. This applies to the registry fee, which is collected when the case is entered in the register.
Costs arising during the proceedings are generally collected while the proceedings are underway.
For some costs a reserve has to be established. In this way, experts are paid from a reserve established by the party that sought the measure of inquiry. Likewise, Article 953 states that the party requesting that a witness be heard must, before such hearing, deposit a reserve with the registrar representing the amount of the allowance and the reimbursement of costs (travel, etc.).
Costs in legal proceedings are sometimes advanced by lawyers and therefore included in their statement of costs and fees.

Cazul A – Situație la nivel național: două persoane se căsătoresc. Ulterior se separă și sunt de acord să divorțeze.
Cazul B – Situație la nivel transfrontalier: două persoane cu calitatea de resortisant al aceluiași stat membru (statul membru A) se căsătoresc. Căsătoria are loc în statul membru A. După oficierea căsătoriei, cuplul se mută în alt stat membru (statul membru B), stabilindu-și domiciliul și desfășurând o activitate profesională în acest stat membru. La scurt timp după aceea, cuplul se separă; soția se întoarce în statul membru A, în timp ce soțul rămâne în statul membru B. Cuplul este de acord să divorțeze. La întoarcerea în statul membru A, soția introduce imediat o acțiune de divorț la instanța din statul membru B.
Observație preliminară importantă: Cheltuielile și onorariile avocaților nu sunt reglementate în Belgia (acestea depind de dificultatea și importanța cauzei, de numele și reputația avocatului, de urgența cauzei, de rezultatul acțiunii etc.). Cu toate acestea, în Belgia, avocații trebuie să respecte anumite norme deontologice și sunt obligați din punct de vedere legal să estimeze în mod just și dând dovadă de moderație costurile și cheltuielile (a se vedea mai sus).

În cadrul prezentului studiu de caz în materie de dreptul familiei – încredințarea copiilor, statele membre au fost rugate să ofere consiliere reclamantului în privința cheltuielilor de judecată în următoarele cazuri:
Cazul A – Situație la nivel național: două persoane au trăit împreună mai mulți ani fără a fi căsătoriți. În momentul în care cei doi se separă, copilul lor are trei ani. Printr-o hotărâre judecătorească copilul îi este încredințat mamei, iar tatăl are dreptul de vizită. Mama introduce o acțiune în justiție pentru a limita dreptul de vizită acordat tatălui.
Cazul B – situația transnațională din perspectiva unui avocat care profesează în statul membru A: două persoane au trăit împreună mai mulți ani într-un stat membru (statul membru B) fără a fi căsătoriți. Au împreună un copil, dar se separă imediat după nașterea copilului. Printr-o hotărâre judecătorească din statul membru B, copilul este încredințat mamei, iar tatăl are dreptul de vizită. Mama împreună cu copilul se mută în alt stat membru (statul membru A), având autorizația să facă acest lucru conform hotărârii judecătorești. Tatăl rămâne în statul membru B. Câțiva ani mai târziu, mama introduce o acțiune în statul membru A pentru a modifica dreptul de vizită al tatălui.

Instalatorul revinde aparatul unui client și îl instalează în locuința acestuia. Casa ia foc la scurt timp după aceea. Toate părțile implicate (producătorul de echipamente de încălzire, instalatorul și clientul final) sunt asigurate. Părțile sunt în dezacord cu privire la cauza incendiului. Nimeni nu vrea să îl despăgubească pe client.
Acesta decide să introducă o acțiune în instanță împotriva producătorului, a instalatorului și a societăților de asigurare pentru a obține o despăgubire integrală.
