Fixed costs for litigants in civil proceedings

In some cases, when the applicant or the intervening party in the proceedings is not Belgian and the respondent is Belgian, the latter may, in the absence of an international agreement providing for dispensation and except in special circumstances, request that the applicant or the intervening party provide surety to guarantee payment of damages arising from the action. This is provided for in Article 851 of the Judicial Code.
The costs of bailiffs and lawyers (see above) and translators and interpreters (see below) must also be taken into account, as appropriate.
Stage in civil proceedings when a party must settle fixed costs
Some costs must be settled before an action is brought. This applies to the registry fee, which is collected when the case is entered in the register.
Costs arising during the proceedings are generally collected while the proceedings are underway.
For some costs a reserve has to be established. In this way, experts are paid from a reserve established by the party that sought the measure of inquiry. Likewise, Article 953 states that the party requesting that a witness be heard must, before such hearing, deposit a reserve with the registrar representing the amount of the allowance and the reimbursement of costs (travel, etc.).
Costs in legal proceedings are sometimes advanced by lawyers and therefore included in their statement of costs and fees.
Fixed costs due from all parties in criminal proceedings
The issue of fixed costs in criminal proceedings is regulated under Article 91 et seq. of the Royal Decree of 28 December 1950.
Variable costs in criminal proceedings
If the victim files a complaint with an application to join proceedings as a civil party with the investigating judge (Article 66 of the Code of Criminal Procedure), the latter has the option to request that the victim deposit a certain amount of money with the registrar of the court. They may, depending on their degree of insolvency, be exempted, in full or in part, from paying the costs of bailiffs, experts, etc. This matter is governed by Article 664 et seq. of the Judicial Code.

In dieser Fallstudie zum Thema Familienrecht (Scheidung) wurden die Mitgliedstaaten gebeten, der Partei, die die Scheidung einreicht, Auskunft über die Verfahrenskosten bei folgenden Fallkonstellationen zu erteilen:
Fall A – Fall ohne Auslandsbezug: Ein Paar heiratet. Später trennt sich das Paar und beschließt, sich scheiden zu lassen.
Fall B – Fall mit Auslandsbezug: Zwei Staatsangehörige des Mitgliedstaats A heiraten. Die Eheschließung findet in Mitgliedstaat A statt. Nach der Hochzeit zieht das Paar in einen anderen Mitgliedstaat (Mitgliedstaat B), wo es seinen Wohnsitz begründet und eine Arbeit aufnimmt. Kurz darauf trennt sich das Paar. Die Ehefrau kehrt in den Mitgliedstaat A zurück, während der Ehemann im Mitgliedstaat B bleibt. Sofort nach ihrer Rückkehr in den Mitgliedstaat A reicht die Ehefrau in Mitgliedstaat B die Scheidung ein.
Wichtige Vorbemerkung: In Belgien sind die Gebühren und Honorare für Rechtsanwälte nicht geregelt (sie richten sich nach der Komplexität und der Bedeutung des Falls, dem Namen und Ruf des Rechtsanwalts, der Dringlichkeit, dem Ausgang des Verfahrens usw.). Die belgischen Rechtsanwälte unterliegen jedoch standesrechtlichen Regeln und sind gesetzlich verpflichtet, einen gerechten und moderaten Kostenvoranschlag zu erstellen (siehe oben).

In dieser Fallstudie zum Thema Familienrecht (Sorgerecht für Kinder) (garde des enfants) wurden die Mitgliedstaaten gebeten, der klagenden Partei Auskunft über die Verfahrenskosten bei folgenden Fallkonstellationen zu erteilen:
Fall A – Fall ohne Auslandsbezug: Zwei Personen haben mehrere Jahre lang unverheiratet zusammengelebt. Als sich das Paar trennt, ist das gemeinsame Kind drei Jahre alt. Das Gericht spricht der Mutter das Sorgerecht und dem Vater ein Umgangsrecht (droit de visite) zu. Die Mutter reicht Klage ein, um das Umgangsrecht des Vaters einzuschränken.
Fall B – Fall mit Auslandsbezug aus der Sicht eines Rechtsanwalts in Mitgliedstaat A: Zwei Personen haben mehrere Jahre unverheiratet in Mitgliedstaat B zusammengelebt. Unmittelbar nach der Geburt des gemeinsamen Kindes trennt sich das Paar. Das Gericht in Mitgliedstaat B spricht der Mutter das Sorgerecht und dem Vater ein Umgangsrecht zu. Mutter und Kind ziehen mit Erlaubnis des Gerichts in einen anderen Mitgliedstaat (Mitgliedstaat A), während der Vater in Mitgliedstaat B bleibt. Einige Jahre später reicht die Mutter in Mitgliedstaat A Klage ein, um das Umgangsrecht des Vaters ändern zu lassen.

Mit Zustimmung des Vaters ziehen Mutter und Kind in Mitgliedstaat A und nehmen dort ihren Wohnsitz.
Einziger Streitpunkt ist die Höhe des Unterhalts, den der Vater der Mutter für den Unterhalt und die Erziehung des Kindes schuldet. Die Mutter reicht deswegen in Mitgliedstaat A Klage ein.

Der Verkäufer beschließt, auf Zahlung des vollen Kaufpreises zu klagen.
Fall B – Fall mit Auslandsbezug: Ein Unternehmen mit Sitz in Mitgliedstaat B liefert Waren im Wert von 20 000 EUR an einen Käufer in Mitgliedstaat A. Der Vertrag ist in der Sprache des Mitgliedstaats B abgefasst und unterliegt dem Recht dieses Staats. Der Käufer in Mitgliedstaat A zahlt nicht, weil die Waren seiner Ansicht nach nicht dem entsprechen, was vereinbart war. Der Verkäufer beschließt, in Mitgliedstaat A auf der Grundlage des geschlossenen Kaufvertrags auf Zahlung des vollen Kaufpreises zu klagen.

Alle Beteiligten (Heizungsanlagenhersteller, Installateur, Kunde) sind versichert. Die Ursache des Brands ist umstritten. Niemand will dem Kunden den Schaden ersetzen.
Der Kunde beschließt, den Heizungsanlagenhersteller, den Installateur und die Versicherungsgesellschaften auf vollen Schadenersatz zu verklagen.
