Regulation (EU) No 1215/2012 of 12 December 2012 and Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters


Regulation (EU) No 1215/2012 (Brussels I Regulation (recast)) replaced Regulation (EC) No 44/2001 as from 10 January 2015. This new Regulation applies only to legal proceedings instituted, to authentic instruments formally drawn up or registered and to court settlements approved or concluded on or after 10 January 2015. The Regulation applies between all Member States of the European Union including Denmark on the basis of a parallel agreement on Regulation 44/2001 with the European Union. This agreement entered into force on 1st July 2007.

Regulation (EC) No 44/2001 continues to apply to judgments given in legal proceedings instituted, to authentic instruments formally drawn up or registered and to court settlements approved or concluded before 10 January 2015 which fall within the scope of this Regulation.

Regulation (EU) No 1215/2012 provides for two forms: a certificate concerning a judgment and a certificate concerning an authentic instrument/court settlement.

Regulation (EC) No 44/2001 provides for two forms.

Submission of forms to competent authority

Completed forms should be sent to the relevant competent authority in a manner required by the authority. More information on the contact details for competent authorities, relevant national legislature etc. can be found in the European Judicial Atlas section. Od 1. siječnja 2021. Ujedinjena Kraljevina više nije država članica EU-a. Međutim, otvoreni postupci u području građanskog pravosuđa koji su započeti prije isteka prijelaznog razdoblja nastavit će se na temelju prava EU-a. Do kraja 2024. Ujedinjena Kraljevina moći će se odabrati u internetskim (interaktivnim) obrascima za potrebe tih postupaka. Iznimka su obrasci javnih isprava, u kojima se Ujedinjena Kraljevina neće moći odabrati.

Imajte na umu da ćete nakon 30 minuta neaktivnosti izgubiti sve podatke koje ste unijeli osim ako ne spremite nacrt!
