National information and online forms concerning Regulation No. 1896/2006.


Council Regulation 1896/2006 of 12 December 2006 creating a European order for payment procedure allows creditors to recover their uncontested civil and commercial claims according to a uniform procedure that operates on the basis of standard forms.

The Regulation applies between all Member States of the European Union with the exception of Denmark.

European order for payment is issued by courts with the exception of Hungary, where order for payment procedure falls under the competence of notaries (civil law notaries).

The procedure does not require presence before the court. The claimant only has to submit his application, after which the procedure will lead its own life. It does not require any further formalities or intervention on the part of the claimant.

The Regulation provides for seven standard forms which were replaced by Commission Regulation (EU) No 936/2012 of 4 October 2012.
Please note that as from 14 July 2017 a modified application form (Form A) entered into use. You can find it here.
Important changes only concern Appendix 2 and reflect the modifications of the European Order for Payment Procedure which came into force as of 14 July 2017.
In a case of the defendant submitting a statement of opposition to an order for payment the modification allows the claimant to choose to transfer the case to a European Small Claims Procedure as a way of dealing further with the claim. The claim has to meet the criteria for the small claims procedure for this to be possible.

Please note that the guide does not reflect two amendments that entered into force on 14 July 2017. The first amendment adds an option of continuation of the proceedings in a case of lodging a statement of opposition in accordance with the rules of Regulation (EC) 861/2007 establishing a European Small Claims Procedure. The second amendment extends the application of the European Small Claims Procedure to claims of a value up to 5000 euro.

For further information in this regard please consult the new text of Article 17 of the Regulation as well as Article 2 of Regulation (EC) 861/2007, as amended by Regulation (EU) 2015/2421.

Em 1 de janeiro de 2021, o Reino Unido deixou de ser Estado-Membro da União Europeia. No entanto, no domínio da justiça civil, os processos e procedimentos pendentes que tiverem tido início antes do final do período de transição continuarão a ser regidos pelo direito da UE. Até ao final de 2024, o Reino Unido pode continuar a ser selecionado em formulários (dinâmicos) em linha, para efeitos desses procedimentos e processos. Os formulários de documentos públicos constituem uma exceção a esta regra, pelo que nesses formulários o Reino Unido não poderá ser selecionado.

Não se esqueça de que se exceder 30 minutos de inactividade perderá todas as informações inseridas caso não guarde um rascunho!
